Resumo
This research aims to demonstrate whether the jus postulandi in the current Brazilian justice
system can provide access to justice through workers’ rights. This conception of access to justice
involves two dimensions: “the expansion of the realization of rights and the expansion of the
possibility of participation in the conformation of rights”. This means that in addition to the right
to access the Judiciary and to know one’s rights, access to justice through rights encompasses the
effectiveness of public policies, such as education, health and housing. It is also important to
highlight that public policies need to be socially fair and must recognize the identity, social and
economic particularities of Brazilian citizens. The research proposal here goes beyond
theoretical data, analyzing the application of jus postulandi in specific social contexts. This
expansion in research techniques can provide new perspectives on the topic. To develop the
thesis proposal, a sociological legal aspect will be used guided by the lenses of the theory of
decoloniality and the paradigms of dialogical reason and complexity to analyze access to justice
through rights in the Amazonian context. Possible results: the principle of jus postulandi, even
with the passage of time and changes in the social, economic and political context of Brazil, still
remains an important instrument for access to labor jurisdiction, and with some adjustments in
judicial and political policies public institutions, this principle presents itself as an institute
capable of providing access to justice through rights.
