Tokenização de produtos de comunidade como medida de proteção de seus conhecimentos

Resumo

Agroecological Traditional Knowledge (TK), the methods and practices related to the cultivation, management, and sustainable use of land and natural resources, face numerous challenges related to misappropriation, commercial exploitation without consent, and unfair compensation for the communities that hold them. New digital tools such as blockchain data registration and tokenization have become allies in protecting these TEKs. This study aims to present the process of tokenization of Guaraná produced by farmers from traditional communities affiliated with the Alto Urupadí Family Farmers' Association (AAFAU) in the municipality of Maués, Amazonas, Brazil, proposing it as a possible defensive means of protecting their knowledge, in which the Guaraná plants are classified, transplanted, managed, and cultivated. The methodology adopted by the author involved the following steps: identifying the critical points within the governance structure of the tokenization process, researching the feasibility of the process based on the authenticity of Guaraná production, proposing the development of a guidebook, and legally structuring the model. To execute these steps, a documentary and legal analysis was conducted to identify mechanisms that would assist the tokenization process. The results obtained so far include the structuring of a declaratory title of possession and ownership of Guaraná, the development of an educational guidebook, and the suggestion of a state law project aimed at regulating tokenization in the Amazon region. The findings indicate that tokenization may be a promising tool for the protection of TEKs and for the integration of these communities into the digital market.
