Acesso à justiça no Amazonas: o projeto de interiorização da Defensoria Pública do Estado do Amazonas na perspectiva da Emenda Constitucional nº 80/2014

Resumo

This research explores the project of expanding the reach of the Amazonas State Public Defender's Office by analyzing access to justice in light of Constitutional Amendment No. 80/2014, with attention to local specificities. The study recognizes access to justice as a fundamental right that remains limited in many regions, especially within the Amazonian context, where geographic isolation, transportation challenges, and technological barriers complicate the realization of basic rights, particularly for vulnerable populations in remote areas. It highlights the importance of adapting mechanisms for the enforcement of rights to the Amazon's unique realities, addressing specific challenges within the local justice system that differ from those in other parts of Brazil. The study argues that the Public Defender’s Office, in its role of providing free legal assistance, is essential for ensuring access to justice for vulnerable individuals. The primary research question examines how legal assistance can be extended to the interior population of Amazonas in the face of structural and material limitations impacting the fulfillment of constitutional rights. The study hypothesizes that the Public Defender’s Office, by operating in remote judicial districts, plays a vital role in making access to justice concrete and in realizing fundamental rights. The general objective is to assess how the Amazonas Public Defender’s Office overcomes obstacles hindering access to justice, with special focus on the interiorization project. Methodologically, the research adopts a qualitative approach, based on bibliographic and documentary review, and uses a hypothetical-deductive method aimed at applying legal theories to the specific context of the Amazon. The conclusion asserts that, to overcome barriers to accessing justice, strengthening the Public Defender’s Office is crucial, particularly in remote regions where much of the population faces economic and social vulnerability. This study aims to contribute to the ongoing debate on access to justice, positioning the Public Defender’s Office as a key element in the realization of fundamental rights for interior communities in Amazonas.
