Proposições de soluções jurídicas aos entraves à gestão administrativa e operacional do Centro de Bionegócios da Amazônia (CBA)

Abstract

This thesis analyzes the legal, administrative, and operational obstacles affecting the management of the Amazon Biobusiness Center (CBA) and proposes applicable solutions from the perspective of Biotechnology Management and Law. The research problem is based on the evidence that legislative rigidity and legal uncertainty are factors limiting the contributions that the Center can offer to bioeconomic development and technological innovation in the state of Amazonas. Characterized as applied, exploratory, and descriptive research, the study adopted a qualitative approach with quantitative support. Primary data were collected through 24 semi-structured interviews with managers, researchers, legal professionals, and representatives of the productive sector, selected using the snowball sampling technique. The results pointed to the following central legal proposals for institutional improvement: adjustments to 10 (ten) legal norms and the creation of 7 (seven) legal norms. However, the most important proposal stands out, materialized in a Legal Opinion suggesting the creation of an Endowment Fund for the CBA. Based on Law No. 13.800/2019 and structured to attract Research, Development and Innovation (R&D&I) resources from the Informatics Law, among other sources, this Fund would act as an important main structuring instrument for research. It is concluded that the implementation of these proposals—especially the Endowment—has the potential to mitigate obstacles to the administrative and operational management of the CBA, guaranteeing financial autonomy, which will facilitate the consolidation of the Center as an active bio-business hub in the Amazon.
